Novato USD Case Resolved – Parents Declare Victory 09.25.2003 Novato, CA – After more than two years of litigation, the lawsuit filed by Pacific Justice Institute on behalf of parents against the Novato Unified School District has finally been resolved. The lawsuit was filed after the school district allowed an age inappropriate presentation to be given in its elementary schools that used objectionable terms like “queer boy” and “lesbo” and promoted acceptance of the homosexual lifestyle. The presentation was enacted before children down to the second grade level, without any prior notice to parents, opportunity for parental review, or parental consent. The school district even ignored opt-out forms that had been filed with the individual schools at the beginning of the year. The schools’ failure to notify parents violated the California Education Code and federal law. During the course of litigation, the school district vacated its original position, replaced its outgoing superintendent with a parent-friendly administrator, and adopted a parental opt-in policy. This favorable outcome was achieved through the cooperation of Pacific Justice Institute Affiliate Attorney Jeff Daly and United States Justice Foundation Attorney Gary Kreep. The parents were satisfied with the resolution and chose to dismiss the lawsuit. They are now looking forward to working with the school district. “We are convinced that as a result of this litigation, this school district and other school districts have learned that undermining the rights of parents will not go unchallenged,” said Brad Dacus, president of the Pacific Justice Institute. “The school district’s ultimate reaction to the law suit provided the parents with much more relief than we ever could have achieved had the case gone to trial.
